Accused In AKA And Tibz Murder Abandon Bail Application. In a dramatic twist that caught many by surprise, the two brothers accused of masterminding the murders of rapper Kiernan “AKA” Forbes and chef Tebello “Tibz” Motsoane have abruptly withdrawn their bail application and will remain in custody until April 17.
Siyabonga Gezani Ndimande and Malusi Dave Ndimande appeared in the Durban Magistrates Court on Friday morning, where proceedings were expected to focus on their long-awaited bail hearing. Instead, their legal team stunned the courtroom by announcing that the application would no longer go ahead.
The brothers, appearing under heavy police guard, showed little emotion as the decision was confirmed. With no application before the court, the magistrate ordered that they be returned to custody at Ebongweni Super Maximum Correctional Facility in Kokstad. This is where they are being held alongside five co-accused.
The sudden reversal comes weeks after the pair had signalled a change in strategy. Earlier in March, they instructed their lawyers to pursue bail after previously showing no intention of doing so. Friday’s development has now undone that move entirely.
The latest turn adds yet another layer to an already complex investigation. What seemed like a routine court step has now accelerated expectations that the matter will proceed directly toward trial.
The killings that shook the country took place on 10 February 2023 on Florida Road in Durban. AKA and Tibz were murdered outside a popular restaurant in an attack that was captured on CCTV footage. The video spread rapidly and triggered widespread outrage, prompting an extensive police investigation.
Authorities allege the Ndimande brothers were central figures in planning the hit, with claims that a significant payment was made to carry it out. The pair were arrested in Mbabane, Eswatini, in 2025 after months of evading capture. Following a prolonged legal battle, they were extradited to South Africa in November of that year.
Together with their co-accused, they now face multiple charges, including murder, conspiracy to commit murder and attempted murder. Due to the seriousness of the case, all seven suspects are being held in a high-security facility to protect the integrity of the investigation.
The family of AKA has remained visible throughout court proceedings. His mother, Lynn Forbes, has attended several hearings and continues to call for justice, describing the killings as a devastating loss not only for the family but for the country’s creative community. With the bail issue now off the table, attention shifts to the upcoming trial phase.
