Speaking to reporters outside the Cape Town Magistrate’s Court on Monday, 19 October 2026, Forbes described the decision as a practical consideration rather than a permanent withdrawal from the legal process.

“It was a decision we made because when there’s a deceased estate, it’s a big decision in terms of where you spend the resources. But it doesn’t mean that we cannot get legal representation still,” he said.

Forbes attended the proceedings for the first time since the inquest opened last month. He had previously been identified as a potential witness for the family and his late son, Kiernan “AKA” Forbes, but withdrew shortly before he was expected to testify.

The inquest is investigating the circumstances surrounding Tembe’s death on 11 April 2021. The 22-year-old died after falling from the 10th floor of the Pepperclub Hotel in Cape Town, where she had been staying with AKA, her fiancé at the time. The inquiry seeks to establish the circumstances of her death and whether there is evidence to support a finding of criminal responsibility.

The Forbes family is also dealing with another major legal battle following the murders of AKA and his close friend, Tebello “Tibz” Motsoane, in Durban in February 2023. The case is being heard in the Durban High Court, adding further emotional and practical demands to an already difficult period for the family.

Questions surrounding the Forbes family’s involvement in the Tembe inquest have followed the proceedings since they began. When the matter first opened in July 2026, it was later postponed after the magistrate experienced a medical emergency. The inquest resumed in September, but the Forbes family had no legal representatives present after its previous lawyers withdrew.

The National Prosecuting Authority had also indicated that it was awaiting clarity on whether the family intended to appoint new legal counsel.

Meanwhile, the Tembe family has maintained legal representation throughout the proceedings. During the September hearings, eight witnesses gave evidence about the events surrounding Tembe’s death, including accounts of an argument at the hotel, screams, and a reported call from AKA requesting security assistance for someone on the balcony. Witnesses also described the immediate aftermath of the fall.

Monday’s proceedings continued with further testimony expected from police officials and medical experts. Some witnesses have reportedly raised objections to their evidence being recorded.

Forbes’s comments offer a clearer understanding of the financial considerations behind the family’s initial decision, while leaving open the possibility of appointing legal representation as the inquest progresses.

With the inquiry continuing alongside the separate murder case involving AKA and Motsoane, the family remains caught between two significant legal proceedings as it seeks answers surrounding the loss of its loved ones. Further evidence is expected to be heard in the coming days.
